Suffering an injury in a work accident can easily turn your life upside down. You may be faced with weeks or months of treatment and rehabilitation. You may have lost income due to the time you missed from work during your recovery. You may even be unable to return to work at all.

St. Louis Work Injury Lawyer

Fortunately, the law in Missouri ensures that workers are compensated for on-the-job injuries. At a minimum, injured workers are entitled to benefits under the workers’ compensation system. When a workplace accident is caused by a third party’s negligence, however, an injured worker may also be entitled to pursue compensation in a personal injury claim.

The work injury lawyers of Sumner Law Group, LLC, have decades of experience fighting for the rights of workers and families. We take a personalized approach to these types of cases, doing everything we can to get your life back on track. You do not have to struggle financially because of an accident at work.

Why Do You Need a Lawyer After a Workplace Accident?

Under Missouri law, an employee injured on the job is entitled to workers’ compensation benefits. Employers are required to pay workers’ comp benefits regardless of who may have been at fault for the worker’s injury (unless the worker engaged in reckless misconduct, such as being intoxicated on the job).

Unfortunately, workers’ compensation only covers reasonable and necessary medical treatment for a work injury. Also, workers’ comp only provides partial wage replacement for missed work or reduced earning capacity due to disabilities.

However, if your workplace injury was caused by someone other than your employer or a co-worker, you may also be entitled to pursue a personal injury claim against that third party. In a personal injury claim, you may be entitled to recover damages beyond what workers’ compensation covers. Those damages include full recovery of lost wages and earning capacity, lost enjoyment or quality of life, and pain and suffering.

Having a lawyer to help you after a workplace injury can ensure that you have pursued all available avenues for financial compensation. A lawyer can also determine the maximum compensation you are entitled to under the law. An injury at work lawyer can handle the hard work of fighting for the financial recovery you deserve.

Tips for Protecting Your Rights
If You’ve Been Hurt on the Job

If you have suffered an injury on the job, take these steps to protect your options for pursuing compensation for your injuries and damages:

  • Report the accident and your injury to your supervisor or employer as soon as possible. Request a copy of any paperwork you fill out or any reports they write.
  • If possible and safe, document the accident scene, including whatever caused the accident and your injuries, the presence of any warning signs or safety equipment, or the weather, lighting, and surface conditions, if relevant. Also, photograph any visible injuries you suffered.
  • Get the names and contact information of any non-co-workers or other companies that were involved in the accident. For example, if a subcontractor on a construction site was responsible for your accident, get the subcontractor’s name and contact details. Also, get the names and contact information of any eyewitnesses to the accident.
  • Get examined by a doctor as soon as possible after the accident and follow all treatment instructions and recommendations. If you delay seeking medical treatment or do not comply with your treatment regimen, this may hurt your claim.

Time Limit for Filing a
Third-Party Work Injury Claim

When a third party causes your work injury, such as a negligent driver who hits you while you are on the job, or the manufacturer of a defective tool that injures you, you may be entitled to pursue a personal injury claim against that third party.

In most cases, you have five years from the date of the work accident to file a third-party injury claim. If you file your lawsuit after the five-year time limit expires, the at-fault party can have your case dismissed. When that happens, you lose your right to seek compensation in court.
